DeCelisGreen is a boutique buyer’s agency, vendor advisory, and property project management practice. We take the privacy of the people we work with seriously, and this policy explains how we collect, use, and protect personal information.

A note on scope. As a small business, DeCelisGreen generally falls under the small business exemption in the Privacy Act 1988 (Cth), meaning the Act does not automatically apply to most of our day-to-day work. However, where we act as a buyer’s agent, we are a “reporting entity” under Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws. For any personal information we collect in connection with that role, the Privacy Act and the Australian Privacy Principles (APPs) apply to us regardless of our size. As a matter of practice, we apply the same standard of care to all the personal information we hold, whether or not the Act strictly requires it.

What personal information do we collect?

Depending on the nature of our engagement with you, we may collect:

your name, contact details, and address;
where you are a buyer’s agent client, your date of birth, occupation, and identification details required for Customer Due Diligence (CDD);
ownership or control information for a legal entity, where relevant to a transaction;
information about the nature, purpose, and source of funds for a transaction, where required under AML/CTF law; and
any other information you choose to share with us in the course of our engagement.

How do we collect it?

Mostly, we collect personal information directly from you, through conversations, engagement documentation, email, or our website. We may also collect information from:

your representatives, such as solicitors, conveyancers, or financial advisers;
selling agents, vendors, or other parties to a transaction;
credit reporting agencies, AUSTRAC, or other government or regulatory bodies, where relevant to AML/CTF obligations; and
publicly available sources.

Why do we collect, use, and disclose it?

We use personal information to:

provide our buyer’s agency, vendor advisory, and project management services;
communicate with you about your engagement with us;
where you are a buyer’s agent client, meet our Customer Due Diligence and other obligations under AML/CTF law, including verifying identity, understanding ownership or control of an entity, and assessing transaction risk; and
where required by law, support reporting obligations to AUSTRAC, and maintain records of our compliance.

Who might we share it with?

We may share personal information with:

our team and any contractors or service providers who support our business, such as website hosting, CRM, or IT providers;
your representatives, where you’ve authorised us to deal with them directly;
AUSTRAC or other regulators, where required by law; and
anyone else, only with your consent.

We do not sell personal information, and we do not share it for anyone else’s marketing purposes.

Customer Due Diligence and identification documents

If we are engaged as your buyer’s agent, we are required to verify your identity before providing that service, and to keep records demonstrating that we’ve done so. We only collect what’s reasonably necessary for this purpose, and in line with current OAIC guidance, we do not retain copies of full identification documents beyond what the law requires us to keep.

If this information isn’t provided, we may be unable to proceed with a buyer’s agent engagement, as the verification step is a legal requirement before we can act for you in that capacity.

Our website may use cookies to understand how visitors use the site and to improve your experience. These don’t collect personal information, and you can disable them through your browser settings if you prefer.

How do we protect your information?

We take reasonable steps to keep personal information secure, including restricting who has access to it and reviewing our practices as our business and obligations evolve. No method of storage or transmission is completely secure, so while we take care, we can’t guarantee absolute security, particularly for information sent to us electronically.

Overseas disclosure

Personal information collected through our website may be stored or processed on servers located in the United States through our website hosting provider. We may also use other third-party technology providers that process personal information overseas in connection with providing our services. Where personal information is disclosed outside Australia, we take reasonable steps to ensure it is handled in a manner consistent with the Australian Privacy Principles.
